PRIVACY AND COOKIES POLICY

ELZ, a company duly incorporated under the laws of the India, with its registered address at 101, Rainbow Building, Baner Road, Pune 411045, hereinafter eAarjav, with its Software assists students, teachers, researchers, and employees around the globe in plagiarism detection and creates new opportunities in education.
eAarjav sets high standards in regards to the Privacy of its Users:

- eAarjav Services shall mean services on plagiarism detection provided under the Licensing Agreement.
- Site shall mean a set of web pages located on the Internet, united by a single theme, design, and a single address space of the domain eAarjav.com and subdomains.
- User(s) shall mean person(s) who accesses the Site using the capabilities of the Site after completing the registration procedure.
- Data Subject shall mean an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
- Personal Data shall mean any information relating to the Data Subject.
- Cookies shall mean small bits of record-keeping text information that are automatically created and stored in the User’s computer or other devices in order to associate and identify activity with the User.
- Controller shall mean a legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any Personal Data are, or are to be, processed. For the purpose of this Privacy Policy, eAarjav is a Controller of their Personal Data.
- Processor shall mean any natural or legal person who processes the data on behalf of the Data Controller. eAarjav may use the services of various Service Providers in order to process their data more effectively.
- Processing shall mean a set of Processor’s actions in relation to the Personal Data of Users, regardless of its location in accordance with the established goals.
- Materials (Documents) shall mean information uploaded by Users to the Site in the form of texts and files.
2.1. eAarjav Services are global by nature. eAarjav may transfer, process, and store some of the Users’ personal information on eAarjav servers in India or globally. Whenever EAarjav transfers any information, EAarjav takes measures to protect it.
2.2. eAarjav may disclose Personal Data on a legitimate request from a public authority (for example, to satisfy national security or law enforcement requirements).
2.3. EAarjav does not transfer Personal Data to any third parties, except for the cases stated in the Section 3.
3.1. In order to provide eAarjav Services, eAarjav may collect or receive data, which may include the information voluntarily provided in the course of filling registration forms, the information provided during the registration process, requests made by the User for other services, or information collected automatically during the course of providing the services.
3.2. Data Users provide eAarjav with
3.2.1. Account Data
3.2.1.1. To gain access to the eAarjav Services, the User must follow the registration process. After the User passes the registration procedure, eAarjav receives and starts processing Personal Data.
3.2.1.2. For the purposes of User registration eAarjav requests the following data: (i) name; (ii) e-mail address; (iii) contact number; (iv) designation; (v) password.
3.2.1.3. eAarjav requests abovementioned Personal Data for the following purposes: sending system messages to the User including, but not limited to, resetting the password or sending important messages about the eAarjav Services, for example, any changes in the functionality of Site and/or changes in legal and technical documents posted on the Site.
3.2.1.4. Upon completion of the registration procedure or once the access is provided, the User may, at his own request, indicate:
- last name;
- name;
- middle name;
- profile image;
The above data will be processed and used for communication purposes between eAarjav and Users.
3.2.2. Anonymous data
eAarjav will also collect anonymized details about visitors and their use of eAarjav Services for the purposes of creating aggregate statistics or reporting purposes. However, no single individual will be identifiable from the anonymized details eAarjav collects for these purposes.
3.2.3. Social Media Login
3.2.3.1. User registration is possible by transferring Personal Data from social media. The User determines the amount of Personal Data transferred from social media independently. eAarjav uses their information from social media account only in accordance with their privacy settings Users have set up under their social media account. Accordingly, eAarjav only uses the information to provide Users with the Service at the given moment. Such information, which Users allowed the social media to share with third parties, is subject to the privacy settings that Users have set in the social media.
3.2.3.2. If the User uses this method of registration on the Site, eAarjav also asks for the minimum Personal Data about the User, namely the e-mail address. The received Personal Data from social media will be used for the purposes of login or sign-up only.
3.2.4. Materials
3.2.4.1. When uploading files for the purpose of using the eAarjav Services to check the presence of text reuse in the text of the document, eAarjav Software compares the text with other documents contained in the database to search for identical fragments of text documents. eAarjav Software automatically retrieves the name of the author of the text if it is contained in the text. eAarjav Software may request the User to provide the name of the author of the text. Users can correct the name of the author of the text. This data is used only to calculate originality percentages and create the Software Report.
3.2.4.2. By uploading a file to the Site, the User creates the Materials.
3.2.4.3. A user who is not the author of the text uploading it to the Site is liable in case of using other people’s Personal Data due to their possible presence in the document.
3.2.4.4. eAarjav has the right to remove the document if eAarjav receives claims for the removal of any document illegally used by the User.
3.2.4.5. Materials and Software Reports are saved in the eAarjav database so that the User can refer to the Software Report, edit it or re-check the Materials. eAarjav uses the content of Materials only for processing User requests and reporting to the User. eAarjav does neither publish nor index Materials, except for the direct request of the User or as defined in the manuals.
3.3. Data eAarjav Collects Automatically
3.3.1. Usage Data
When the User uses the Site, information about (i) the IP addresses of the Users; (ii) log-files; (iii) browser type; (iv) device screen size is automatically collected for the purposes of monitoring the attendance of the Site.
3.3.2. Cookies and Similar Technologies
3.3.2.1. eAarjav and its partners may use cookies or similar technologies to analyze trends, administer the Site, track Users’ activities on the Site. It does not use Cookies for profiling.
3.3.2.2. Cookies do not typically include names and/or email addresses and/or other Personal Data. In fact, they typically contain anonymous information that is required for the better functionality of the Services.
3.3.2.3. eAarjav uses the following first-party cookies on the Site:

Cookie Name – .AspNetCore.Culture.E, Expiration – Session, Description – Used to store information on which language Users prefer
3.3.2.4. Users can control whether or not cookies are allowed through their browser. If the User chooses to disable cookies, the browser may limit the use of certain features or functions of the Site or service.
3.3.2.5. eAarjav may use third-party analytics providers software to allow eAarjav to better understand the functionality of eAarjav Software on Users’ devices, including but not limited to, Google Analytics (collectively “Third Party Analytics Providers”). They collect only anonymous User data. eAarjav does not link the information within the analytics software to any personal information Users submit within the eAarjav Services. The information about Users’ use of eAarjav Services, may be transmitted to and stored by Third-Party Analytics Providers’ servers.
3.3.2.6. The following are third parties that eAarjav uses for analytics:
Google Analytics
Google Analytics collects information such as how often Users visit this Site, what pages they visit when they do so, and what other sites they used prior to coming to this Site. Google’s ability to use and share information collected by Google Analytics about their visits to eAarjav Services is restricted by the Google Analytics Terms of Use (as amended for government websites) and the Google Privacy Policy. Users can prevent Google Analytics from recognizing Users on return visits to this Site by disabling cookies on their browser or mobile device. For more information about Google Analytics, please see the Google Privacy Policy at https://policies.google.com/privacy?hl=en.
To prevent Google Analytics from using their data through a web browser, Users can get the Google Analytics Opt-out Browser Add-on at https://tools.google.com/dlpage/gaoptout/.
3.4. eAarjav does not verify the authenticity of the Personal Data provided by the User. eAarjav policy is based on the fact that the User provides reliable and sufficient personal information to register on the Site or provided by the customer representative for users within the customer organization.
3.5. The accuracy of the Personal Data provided by the User is presumed unless proven otherwise.
3.6. The User is responsible for the authenticity of the Personal Data specified by him during the registration procedure on the Site, as well as for all consequences, damages, and harm caused to third parties and the Controller arising as a result of this.
4.1. During the processing of Personal Data, the following actions can be taken: collection, recording, systematization, accumulation, storage, change (updating, modification), extraction, use, blocking, deletion.
4.2. The processing of Personal Data is carried out by the Processor by maintaining databases in an automated manner or by other lawful means.
4.3. Users, regardless of the applicable mode, submit Consent to the processing of Personal Data for each of the specified processing purposes. eAarjav keeps before the withdrawal or until the receipt of the notice of the removal of the data the consent. eAarjav takes all possible measures to remove the User’s data as soon as possible from the moment the application is received from the User.
4.4. In cases of changes in the methods of collection, storage, and processing of Personal Data, as well as in cases of changes in the requirements of the current legislation on Personal Data or by the decision of eAarjav has the right to change the terms of this Privacy Policy. In case the User does not agree with the new edition of the Privacy policy, the User has the right to withdraw his consent in the order established by Section 5.
4.5. Personal Data is not available to other Users of the Site.
5.1. Users have certain choices available to them when it comes to their information. Below is a summary of those rights, how to exercise them, and any limitations.
5.2. Delete User’s Data (Right to Erasure): In certain territories Users can ask eAarjav to erase or delete all or some of their Personal Data (e.g. if it is no longer necessary to Provide Services to Users). As a result of deleting their Account, Users will lose access to most eAarjav Services, including the Account access and information linked to the Account.
5.3. Right to Object: In certain territories where the processing of their Personal Data is based on legitimate interests, Users can use their right to object at any time. If Users object, eAarjav will no longer process their Personal Data unless there are compelling and prevailing legitimate grounds for the processing, or the data is necessary for the establishment, exercise, or defense of legal claims.
5.4. Access User’s Data (Right of Access): Upon their request, eAarjav will provide Users with a copy of their Personal Data in a structured, electronic format.
5.5. Change or Correct User’s Data (Right to Rectification): Users can edit some of their Personal Data through their account. Users can also ask eAarjav to change, update or fix their data in certain cases, particularly if it’s inaccurate.
5.6. Users have the right to request a copy of their information, to object to eAarjav use of their information, to request the deletion or restriction of their information, or to request their information in a structured, electronic format.
6.1. eAarjav strictly follows the privacy rules of the Personal Data of all Site Users.
6.2. eAarjav takes all necessary measures to protect Personal Data provided by the User from unauthorized access, alteration, disclosure, or destruction, including: provides continuous internal verification of data collection, storage and processing processes and security; provides physical security of the data, preventing unauthorized access to the technical systems providing the work of the Site, in which the Processor stores Personal Data; provide access to Personal Data only to those employees of the eAarjav or authorized persons to whom this information is necessary for the performance of labor duties, as well as the exploitation, development, modification, changes, and improvement of the Site.
6.3. The information publicly disclosed by the User, as well as information that can be received by the parties or third parties from sources to which there is free access to any person is not confidential.
6.4. eAarjav never sends any e-mails to the User with a request to indicate (excluding situations when the eAarjav asks for confirmation of the first entered data) or otherwise inform the Processor their e-mail address and password when registering on the Site or log in, or the details of access to other social media.
6.5. In case the User loses the details of access to the Site (e-mail address and/or password), a message to the User of the lost details is carried out by eAarjav. In order to receive the message, the User should request the support service. The user receives the requested data at the e-mail address specified during registration on the Website or at the specified e-mail address in the User’s request.
6.5. The Controller and the Processor take the necessary measures or ensure their acceptance of the protection of Personal Data from unauthorized access to them, the result of which can be the destruction, modification, blocking, copying, provision, distribution of Personal Data, as well as other illegal actions in their processing. At the same time, the Controller and the Processor shall not be liable for the safety of Personal Data in the event of hacking of their protection by intruders (third parties) using technical and other means and capabilities, as well as in the case of the transfer or failure of the User to exercise due diligence in the matter of preserving his Personal Data.
6.6. Users must analyze the text for the availability of state, commercial, tax, medical, banking, and other secrets before uploading the document to the Site and, in case of any secrecy in the document, assess the possibility of placing the document on the Site. Due to the specifics of the site’s service, eAarjav does not have the ability to analyze the text. In case of disclosure of information that is a state, commercial, tax, medical, banking, or another secret by posting text on the Site, the responsibility is assigned to the User. In the event that eAarjav has adverse consequences in connection with the disclosure by the User of information that is a public, commercial, tax, medical, banking, or another secret, eAarjav has the right to demand compensation for damages by the User.
6.7. eAarjav endeavors to keep their Personal Data safe and secure at all times.
6.8. eAarjav data is stored with robust physical, digital, and procedural safeguards in place to protect Users Personal Data, including the use of SSL encryption, redundant servers, and data centers, and sophisticated perimeter security.
6.9. eAarjav continuously audits for security vulnerabilities and makes software patching a priority. The password is required to access the Site services and Personal Data, therefore, Users should keep the password confidential.
7.1. Users under the age of 16 years are not allowed to register on the Site.
7.2. eAarjav does not knowingly request, process, or store information about the date of birth of the User and his age.
7.3. In case of detection of violation of the age limit by Users, eAarjav immediately stops processing such User’s Personal Data.
7.4. If Users believe that eAarjav might have any data from or about a child under the age of 16, they may contact eAarjav.
8.1. eAarjav does not advertise on its Site.
8.2. eAarjav does not send advertising messages to its Users.
8.3. eAarjav places advertisements of its services on various sites on the Internet. eAarjav cooperates with third parties to manage advertising on other sites. It is subject to the privacy policy that is set on other sites.
9.1. eAarjav stores the User’s data until the Account is deleted and is necessary for the provision of services to the User.
9.2. eAarjav has the right to delete the Account and all the data upon expiry of the Licensing period or in case the User violates the terms and conditions of the Licensing Agreement.
9.3. Users may withdraw consent where the processing of their Personal Data is based on consent, by contacting eAarjav as explained in Section 11. If Users withdraw their consent, it will not affect the lawfulness of processing based on their consent before its withdrawal.
10.1. Due to the fact that the legal requirements for data confidentiality can be changed, supplemented, eAarjav reserves the right to amend this Privacy policy as necessary and in accordance with the requirements of the law.
10.2. eAarjav will post any privacy policy changes on this page and, if the changes are significant, eAarjav will provide more prominent notice by adding a notice within the Software or by sending Users an email notification.
10.3. eAarjav encourages Users to review this Privacy Policy whenever Users use the Services to stay informed about eAarjav information practices and the ways Users can help protect their privacy.
